This mobile application is not affiliated with any government entity. It is an independent application developed for informational purposes only. The information provided within this application is sourced from the official website of the Regional Transport Office (RTO), https://parivahan.gov.in. This application is designed to complement and enhance the user's access to information related to regional transport, but it is not a substitute for official government services. Users are encouraged to use their discretion and consult official channels for the most up-to-date and accurate information. We just provide a service to submit the user's application to the official RTO website for the user's convenience.

AGREEMENT TO OUR LEGAL TERMS

These terms and conditions (“Terms”) constitute a binding and enforceable legal contract between EASY RTO, a partnership firm, having its registered office at A-1206, Sankalp Iconic, Opp. Vikramnagar, Iscon Temple Cross Road, S.G. Highway, Ahmedabad - 380054, Gujarat, India (the “Firm”, “we”, “us” or “our”) and the user (“you, your or user”)

The Firm owns and operates this application (“Application”), which, inter alia, provides various services with an aim to support to users in filling online forms / applications on website of the Regional Transport Office (“RTO”) (“Services”). These Terms shall govern the access to this Application and / or use of Services.

If you do not agree to any of the provisions of this Terms, you shall promptly stop using this Application, do not subscribe for any Services and immediately remove / uninstall this Application from your device. By using the Application / subscribing for one or more Services, you hereby agree to all the Terms.

The Terms are subject to corrections from time to time as per the discretion of the Firm. Any such correction of the Terms shall be binding on the user.

The Services are only for the users who are aged 18 years or more and are legally competent to enter into his contract with the firm.

These terms and conditions are in addition to the EASY RTO Privacy Policy (which is incorporated here by reference) and any other agreements executed between you and EASY RTO, including any customer or account agreements, and any other agreements that govern your use of information, content, tools, products and services available on and through EASY RTO Sites.

1. OUR SERVICES RELATED TERMS.

 

General conditions:

1. EASY RTO will fill up required details in your application / form based on the information / documents provided by you from time to time and in the manner specified by the RTO. Accordingly, you hereby authorised us to collect the documents so submitted by you, use the information recorded on the said documents for the purpose of filling in your application / form, submit the said application / form on the RTO website on your behalf and accept the terms and conditions of the RTO website on your behalf, if any, in relation to the said online services provided by the RTO or otherwise.
2. We will submit an application / form on your behalf on the RTO portal with documents and fees provided by you with utmost care and caution for the Services chosen by you on the Application. Our role therefore shall be limited to prepare an application / form on your behalf based on the details provided by you. You shall be solely responsible / answerable for the application / form prepared by us. We do not guarantee acceptance of your application / form by the RTO or any time period in relation to that. Use of the Services by you shall be solely at your own risk and consequences.
3. Some RTO services (Non-Faceless Service) which require physical presence will be fulfilled only by you. The application / forms for faceless services are approved by the authority within the time limit. The time limit has been fixed by the Government in the Citizen Chartered/Right to Citizen Services Act. In case of faceless service your Aadhaar based E KYC is not possible and data related issues arise you have to visit the RTO office, also in this service anytime authority requires your presence you have to fulfil it.
4. if Your name is not the same in Aadhaar card and driving licence then you will not be eligible to apply for faceless services.
5. You have to go through a Learning licence and driving licence test. All formalities regarding the test are fulfilled by the applicant. All tests are compulsory and must be passed by the applicant as prescribed by the government.
6. Whenever required for any medical test, applicants have to get a certificate from mbbs doctor.
7. The User shall be responsible for submitting necessary documents and required information as the EASY RTO requires along with any request for any service under EASY RTO mobile application. If any request for a service is such that it cannot be given effect to unless it is followed up by requisite documentation, the EASY RTO not be required to act upon the request until it receives such documentation from the User.
8. Anytime driving licence, insurance, tax, registration, fitness, PUCC, permit and other certificates expire during the process of filling an application and if the process cannot proceed without them, the user has to renew those documents. all the cost will be regarding that renewal is on the head of users. Without that renewal the firm will not process further, for this incident if any loss or rising in government fees or process of application will be changed, sole responsibility on the app user only.
9. At any time, the government raises the fees for any application, users are responsible for that fee.
10. We have the right to change your service any time if we need to. If any difference between the old total fees and new fees arises, you will have to pay it.

 

E KYC and OTP related terms:

Contactless, faceless & no need to visit RTO Services are OTP based E KYC. So, if you have to obtain the said Services from us, you will have to upload the said OTP generated by parivahan or Aadhaar card service in the Application. In such case, you acknowledge and confirm that sharing / submitting of the said OTP on the Application was at your discretion and that we did not force you to submit the same on the Application. For payments we have a well-known and equipped payment gateway company named CCAvenue. For your convenience our representative will call you for your availability and then generate the OTP so you have to submit the application only and only our app.

The Internet per is susceptible to cyber-crimes like phishing, vishing (Voice phishing), SMSing (phishing through SMS), compromising of User's system security, etc That could affect instructions to the EASY RTO. While the EASY RTO shall endeavour to protect the interests of users, there cannot be any guarantee against such cyber-crimes and other actions that might affect security of information. The User shall separately evaluate all such risks and the EASY RTO shall not be held responsible for any losses arising out of such cyber-crimes. The User also understands that doing a transaction at a Cyber- Cafe/shared computer terminal is risky, and shall avoid using the services of a Cybercafe/shared computer terminal to use the EASY RTO.

 

Time and loss related conditions:

There is no time limitation for us to submit your application in the government portal because of technology viability risk. We advise you to place an application on our EASY RTO app at least 30 days before expiry of such documents/ certificates, in case your data is not online in parivahan portal we advise you to apply before 60 days.

The app User understands that the EASY RTO disclaims any and all liability, whether direct or indirect, whether arising out of loss or otherwise arising out of any failure or inability by the EASY RTO to honour any customer instruction for whatsoever reason. For a filling application delay by the EASY RTO, resulting in rising government fees, or going through the driving test or whatsoever the outcome is there by for which incident EASY RTO is not responsible. The firm cannot be held responsible for any type of loss, accident.

The parivahan and other government sites may require maintenance and during such periods it may not be possible to process the requests of app users. This could result in delays and/or failure in processing instructions.

Licence, certificate and other documents issued under motor vehicles act1988 are required to be renewed. App user submitted a document and paid us. We will try to submit your application as soon as possible. But if some delay occurs, and application fee and process will be changed, app user/applicant have to bear change of the process and fees.

 

Cases like:

Driving licence renewal.

In Gujarat state: you submit a driving licence renewal application and pay us, for a simple driving licence renewal application must be done within one year from expiry date.

In the first case, if your licence data is not on the Vahan portal we will apply for that, after approval of the application we will apply for renewal of licence. Backlog of the licence is not time bounded service so how much time required we cannot say.

Second case, we will send you a medical certificate, you have to provide it within a timely manner with a doctor signature and stamp.

Third case: technological risk, if the government portal is not in working condition for a long time, if internet service is stopped by the authority, if there is difficulty in getting your Aadhar E KYC, our representative related issue etc.

In the above three cases, the application is made one year after the driving licence has ceased to be effective. Then You have to pay a different fee and go through the driving test.

In the new licence / addition of class into driving licence:

Learning licence's validity is six months. If you have not passed the driving test or not attended the driving test in six months you have to renew your learning licence. After renewal you can go for a driving test after 30 days. you have to bear the learning licence's renewal fee.

If the PUCC certificate expires during the application process, you have to compulsory get a new one. Without an effective PUCC process cannot be done. Application remains pending for documents requested.

If the vehicle insurance expires at the time of applying, the app user will have to take a new insurance.

 

Condition regarding services:

In new licence / add class to licence

Application for this filled by us. We will help you in taking appointments for learning and driving tests for one time only. If you fail in those tests you have to go through our service appointment and fee. You have to pay the retest fee and convenience fee, if you need that service.

We have the right to change your service any time from a new licence to appointment and fees.

In the new licence your name and date of birth is as per schooling certificate, address is as per Aadhar card. If you requested us to change during the process, all responsibility is bare by you only.

If you are found physically unfit during the test, refund will not be possible by us if government fees are already paid. For refund You will have to apply to a concerned government office. Refunds will be as per rules made by the government.

Users have to provide mobile based OTP for E KYC in our app platform.

 

Renew licence

Whenever required for any medical test, applicants have to get a certificate from MBBS doctor. Renewal of driving licence is possible before and after one year from expiry date. So, we advise you to renew before 3 months from the expiry date. Users have to provide Aadhaar based OTP for E KYC in our app platform. If Your name is not the same in Aadhar card and driving licence then you will not apply for faceless services.

In Gujarat state this service is faceless so no need to visit RTO office but some old data is not found in RTO office. In this case if your data is not found there, on call of authority you have to go to visit the office. We will help you in the form filling process.

International licence

Whenever required for any medical test, applicants have to get a certificate from MBBS doctor. In international licence we advise you to make an application before 30 days to us and if data is not available on parivahan then 90 days before your travel, so service will be hassle free. Users have to provide Aadhaar based OTP for E KYC in our app platform. To change of address/ change of name in licence

Users have to provide Aadhaar based OTP for E KYC in Application. Whenever required for any medical test, applicants have to get a certificate from MBBS doctor. Documents for change of name are marriage certificate, passport and gazette required.

Documents for address change are Aadhar card and election card. If Your name is not the same in Aadhaar card and driving licence then you will not apply for faceless services.

Old license data online (m parivahan and Digi-locker)

To change photo / to renew broken licence /update mobile number.

Loan remove (hypothecation cancel)

Users have to provide Aadhaar based OTP for E KYC in our app platform. If Your name is not the same in Aadhaar card and driving licence then you will not apply for faceless services.

 

Genuineness of Documents / Other Information:

EASY RTO is in the role of facility provider. We upload documents and information provided / uploaded by the users on the RTO website and that too on the behalf of the user. User further acknowledges that uploading of forged documents / providing false information to the RTO website would amounts breach of laws including but not limited to breach of provisions Indian Penal Code, 1860 and Information and Technology Act, 2000. Breach of provisions of such laws have severe consequences. User therefore undertakes that the documents so submitted and / or information provided to EASY RTO by the user shall be true and genuine. User further agree to indemnify EASY RTO, their partners, employees, associates, etc. from all the losses, damages suffered by them due to submission of incorrect information / forged documents on RTO website on their behalf.

 

Medical condition:

Note: We are providing support in submitting applications to the government portals with information and documents provided by app users, we feed online what you feed us.

In learning licence and driving licence physical fitness required as per described by the government. We are giving services to physically fit persons only. At any stage the user or applicant is found unfit, we have no corner for it. If government fees are already paid so no refund will be possible. In case of above 40 years age and renewal of licence, international licence required fitness certificate from MBBS doctor. If you are found unfit then we will give you a refund as per refund conditions.

You were found unfit before government authority, it's all your look out. EASY RTO is only providing help in application creations.

EASY RTO provide only supports application related issues. In learning licence or new licence application government fees paid in advance so no refund possible. We will ask you questions regarding your fitness as per form 1, and the answers will be put on parivahan portal for new licence application.

In these questions you find physically unfit for a driving licence. We will suggest you stop further process; we will give you a refund as per refund condition. further Process on Application is your call. If you want to apply for an adapted vehicle licence, our representative will assist you. But in case for physical fitness, we have no role, we provide only application related service.

However, if you give us wrong information, an application based on your information on behalf of you is submitted on the portal. Our clear condition is that there is no role for physical fitness, and no refund is possible if government fees were already paid.

In case of a new licence application, the applicant age is above 40 years and renewal of licence. for this process medical certificate required. In this process, if you have been declared medically unfit, the refund will be given as per refund condition.

 

2. USER REPRESENTATION.

By using the Services, you represent and warrant that:

All registration information you submit will be true, accurate, current, and complete;

You will maintain the accuracy of such information and promptly update such registration information as necessary;

You have the legal capacity and you agree to comply with these Terms;

You will not access the Services through automated or non-human means, whether through a bot, script or otherwise;

You will not use the Services for any illegal or unauthorised purpose; and Your use of the Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

 

3. USER REGISTRATION & SECURITY.

You may be required to register to use the Services. you will be responsible for all use of your account. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

You are in charge of protecting the privacy of your Display Name and Password if you use the Platform, and you are also accountable for any actions taken using those details. You acknowledge that We shall have the right to permanently suspend, terminate, or restrict access to your membership on the Platform if You supply any information that is untrue, inaccurate, out of date, or incomplete.

You are solely responsible for all documents and information provided for any service and also responsible for third party loss. E KYC OTP is provided by fraud way through your user id, you are responsible for that.

You consent to any unauthorised use or breach of your password or account must be reported right once to EASY RTO. Make sure to log out of your account after each session.

 

4. FEES CHARGES MODIFICATION.

The firm reserves the right to charge convenience fee for the Services and non-payment may result in denial of Services and/or action under applicable law. Also, the firm reserves the right to change convenience fee at any time. The firm reserves the right at any time to add, modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without cause. The Company shall not be liable for any such addition, modification, suspension or discontinuation of the Services.

 

5. MOBILE APPLICATION LICENSE.

Use Licence

If you access the Services via the Application, then we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the Application on wireless electronic devices owned or controlled by you, and to access and use the Application on such devices strictly in accordance with the terms and conditions of this mobile application licence contained in these Terms. You shall not: (1) except as permitted by applicable law, decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the Application ; (2) make any modification, adaptation, improvement, enhancement, translation, or derivative work from the Application ; (3) violate any applicable laws, rules, or regulations in connection with your access or use of the Application ; (4) remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) posted by us or the licensors of the Application ; (5) use the Application for any revenue-generating endeavour, commercial enterprise, or other purpose for which it is not designed or intended; (6) make the Application available over a network or other environment permitting access or use by multiple devices or users at the same time; (7) use the Application for creating a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the Application ; (8) use the Application to send automated queries to any website or to send any unsolicited commercial email; or (9) use any proprietary information or any of our interfaces or our other intellectual property in the design, development, manufacture, licensing, or distribution of any applications, accessories, or devices for use with the Application.

 

Apple and Android Devices

The following terms apply when you use the Application obtained from either the Apple Store or Google Play (each an 'App Distributor') to access the Services: (1) the licence granted to you for our Application is limited to a non-transferable licence to use the application on a device that utilises the Apple iOS or Android operating systems, as applicable, and in accordance with the usage rules set forth in the applicable Application Distributor’s terms of service; (2) we are responsible for providing any maintenance and support services with respect to the Application as specified in the terms and conditions of this mobile application licence contained in these Terms or as otherwise required under applicable law, and you acknowledge that each Application Distributor has no obligation whatsoever to furnish any maintenance and support services with respect to the Application; (3) in the event of any failure of the Application to conform to any applicable warranty, you may notify the applicable Application Distributor, and the Application Distributor, in accordance with its terms and policies, may refund the purchase price, if any, paid for the Application, and to the maximum extent permitted by applicable law, the Application Distributor will have no other warranty obligation whatsoever with respect to the Application; (4) you represent and warrant that (i) you are not located in a country that is subject to a US government embargo, or that has been designated by the US government as a 'terrorist supporting' country and (ii) you are not listed on any US government list of prohibited or restricted parties; (5) you must comply with applicable third-party terms of agreement when using the Application, e.g. if you have a VoIP application, then you must not be in violation of their wireless data service agreement when using the Application; and (6) you acknowledge and agree that the Application Distributors are third-party beneficiaries of the terms and conditions in this mobile application licence contained in these Terms, and that each Application Distributor will have the right (and will be deemed to have accepted the right) to enforce the terms and conditions in this mobile application licence contained in these Terms against you as a third-party beneficiary thereof.

 

6. SERVICES MANAGEMENT.

We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Terms; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Services or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.

 

7. TERM AND TERMINATION.

These terms shall remain in full force and effect while you use the services. without limiting any other provision of these terms, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the services (including blocking certain ip addresses), to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these terms or of any applicable law or regulation. we may terminate your use or participation in the services or delete your account and any content or information that you posted at any time, without warning, in our sole discretion.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

 

8. MODIFICATIONS AND INTERRUPTIONS.

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Services. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance of the Services. Nothing in these Legal Terms will be construed to obligate us to maintain and support the Services or to supply any corrections, updates, or releases in connection therewith.

 

9. JURISDICTION, GOVERNING LAWS, AND DISPUTE RESOLUTION.

These Terms shall be governed by and construed and enforced in accordance with the laws of India. Subject to other provisions in this Clause, courts in Ahmedabad, Gujarat shall have exclusive jurisdiction over all issues arising out of these Terms or the use of the Services.

 

10. DISCLAIMER

The services are provided on an as-is and as-available basis. you agree that your use of the services will be at your sole risk. to the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the services and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. we make no warranties or representations about the accuracy or completeness of the services' content or the content of any websites or mobile applications linked to the services and we will assume no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content and materials, (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the services, (3) any unauthorised access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from the services, (5) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the services by any third party, and/or (6) any errors or omissions in any content and materials or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the services. we do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the services, any hyperlinked website, or any website or mobile application featured in any banner or other advertising, and we will not be a party to or in any way be responsible for monitoring any transaction between you and any third-party providers of products or services. as with the purchase of a product or service through any medium or in any environment, you should use your best judgement and exercise caution where appropriate.

 

11. LIMITATIONS OF LIABILITY.

The firm disclaims all responsibility for any accidents that might arise as a result of your use of our services and cause harm to people, property, or the economy. You acknowledge and agree that regardless of the legal theory (warranty, contract, tort, or otherwise), firm shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses (even if firm had been advised of the possibility of such damages). The overall liability of the firm shall not be more than amount paid by you as our fees for the relevant Services.

 

12. INDEMNIFICATION.

You agree to hold the firm, subsidiaries, affiliates, and each of their officers, employees, directors, licensors, agents, and representatives harmless from and against any claim, demand, lawsuit, loss, liability, damages, and costs (including, without limitation, from all damages, liabilities, settlements, costs, and attorneys' fees) resulting from or arising out of breach of Terms by you.

 

13. USER DATA.

For the purpose of managing the operation of the Services, we will keep some of the information you send to them, as well as information about how you use them. Despite the fact that we regularly backup your data, you are exclusively in charge of any data you send or that pertains to any action you do while using the Services. You acknowledge that we are not responsible for any loss or corruption of such data, and you hereby release us from any claims you may have regarding such loss or corruption.
